Building Board of Appeals

The Building Board of Appeals reviews requests for alternative building materials and construction methods. The Board also provides formal interpretations of the International Building Code.


About the Board of Appeals

The City of Bullhead City has established a Board of Appeals to review decisions made under the 2018 International Building Code. This board hears appeals related to how the code is applied and interpreted.

  • The Board is appointed by the City Council.

  • Members serve at the pleasure of the City Council.

  • The Board follows a formal set of rules and procedures.


Meeting Schedule

The Building Board of Appeals meets on the fourth Tuesday of each month at 5:30 p.m. in the Council Chambers, or as needed.


How to Submit an Appeal


Contact Building staff to initiate an item to go before the Building Board of Appeals contact Building Division staff.

When Can You Appeal?

You can file an appeal if:

  • You believe the building code has been misinterpreted.

  • You believe the code does not apply to your situation.

  • You propose an alternative design or method that is equally safe or better than what the code requires.

Important: The Board of Appeals cannot waive any part of the building code. It may only review how the code is interpreted or applied.


Who Serves on the Board?

The Board consists of five members appointed by the City Council. Each member serves a staggered two-year term. Members elect a Chairperson and Vice Chairperson annually to serve one-year terms. All members serve on a volunteer basis.

Board members must:

  • Have experience and training in building construction.

  • Not be employed by the City of Bullhead City.


Contesting Building Board of Appeals Decisions


If you disagree with a decision made by the Building Official regarding the application or interpretation of the building code, you may request a hearing through the City’s Board of Appeals.

CHAPTER 1 ADMINISTRATION

SECTION 112 BOARD OF APPEALS

112.1 General.


In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. The board of appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business.

112.2 Limitations on authority.


An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply or an equally good or better form of construction is proposed. The board shall have no authority to waive requirements of this code.

112.3 Qualifications.


The board of appeals shall consist of members who are qualified by experience and training to pass on matters pertaining to building construction and are not employees of the jurisdiction.
