Arizona Proposition 207 – Marijuana Legalization and Expungement
Arizona voters approved Proposition 207 (Smart and Safe Arizona Act) on November 3, 2020. The initiative legalized, regulated, and taxed recreational marijuana for adults aged 21 and older.

Marijuana Expungement
Proposition 207 created A.R.S. § 36-2862, which allows certain marijuana-related criminal records to be sealed.
You may be eligible to petition the court for expungement if you were arrested, charged, convicted, or acquitted for conduct before November 30, 2020, involving:
- Possessing, consuming, or transporting 2.5 ounces or less of marijuana (no more than 12.5 grams in concentrate form).
- Possessing, transporting, cultivating, or processing up to 6 marijuana plants at your primary residence for personal use.
- Possessing, using, or transporting marijuana-related paraphernalia.
How to File a Petition
The Arizona Supreme Court has created forms and instructions for filing a petition to seal records under Proposition 207.
